Terms and Conditions
This ‘Terms and Conditions’ document (“T&C”) governs the end users’ (“You/Your/User”) access to and use of ‘Spotlight - Sessions by Toabh’ (which term shall be deemed to include the internet and mobile website www.spotlight.toabh.com as well as its mobile application and any other means to access the same from time to time) and the services offered thereunder.
The Spotlight Platform is owned and controlled by Toabh Talent Management, with its registered office at having its registered address at Plot, No, 5th Floor, Victoria Plaza, 19, SV Rd, Santacruz West, Mumbai, Maharashtra 400054 (hereinafter referred to as " Toabh/Us/Our/We"). Through the Spotlight Platform, Toabh provides to You information in relation to sessions that are organized by third-party entities. However, when you purchase a session, show, or content available on Spotlight Platform, then for the purpose of this T&C, You will be considered as a customer of Toabh only. Which is the parent entity having ownership of the brand, ‘Spotlight’. You agree that for any issue or grievance under these T&C, Your recourse shall be solely to Toabh.
It is clarified that terms and conditions specific to sessions in respect of which Toabh has facilitated sale of registration fees through the Spotlight Platform (“sessions”) shall be published on the sessions page accessible on the Spotlight Platform. Toabh publishes such information as provided by and on behalf of the organizer associated with such sessions (“sessions Organizer”). In the sessions of any conflict between the sessions-related terms and conditions, and this T&C, User agrees that the sessions-related terms and conditions shall prevail and be binding on the User at all times.
Payment refund and cancellation policy
Full payment to be made at time of purchase of course
Once purchased, no partial or full refund will be provided, unless there is an exceptional circumstance which will be decided by Toabh on a case to case basis
No exchanges between courses after purchase will be allowed
Toabh does not have any recurring subscription charges which a customer has to pay
Toabh does not store any of your payment information (debit card, credit card, net banking, etc.) or such other information restricted by the Reserve Bank of India (RBI) for processing payment and has partnered with payment gateways for the payment towards the services. In case of any other payment, refund or cancellation issues, decisions will be taken on a case by case basis and Toabh's decision will be final and binding.
The entire content included in the Spotlight Platform, including but not limited to text, graphics or code is copyrighted as a collective work under the Indian and all other copyright laws of the world, and is the sole property of Toabh or is appropriately licensed by Toabh from the relevant owners thereof. At no point of time, will the User have any rights and/ or claim to have acquired any rights in and to any part or portion of the Spotlight Platform and/ or any content contained therein, in any manner whatsoever.
You may display and, subject to any expressly stated restrictions or limitations relating to specific material, download or print portions of the material from the different areas of the Spotlight Platform solely for Your own non-commercial use, or to place an order with Spotlight Platform or to purchase Spotlight Platform products.
Any other use, including but not limited to the reproduction, distribution, display or transmission of the content of the Spotlight Platform is strictly prohibited, unless specifically authorized by Toabh in writing.
All trademarks, service marks and trade names of 'Toabh' used on Spotlight Platform are trademarks or registered trademarks of Toabh Entertainment Pvt. Ltd. At no point of time, will the User have any rights and/ or claim to have acquired any rights in and to any part or portion of the ‘Toabh’ trademarks and/ or logos, in any manner whatsoever.
We accept Visa, MasterCard, American Express, Debit Cards, International Cards via Stripe, Net Banking, Paytm Wallet, UPI, and PayU Money through the integrated registration system available only on Spotlight Platform. For certain sessions, we will also accept offline payment modes including cash / cheques only through authorised promoters, whose details will be listed on the respective sessions pages. If you are purchasing registration fees from anywhere outside of the Spotlight Platform, including through any authorized promoters, it shall be completely your own responsibility to verify the genuineness of the source and authenticity of the registration fees issued to you. PRICING, OFFERS, AVAILABILITY, AND SEAT CONFIRMATION
Spotlight Platform is a registration fees-based platform and sells registration fees on behalf of sessions Organizers and therefore has no control over its availability, offers, and pricing. If the sessions Organiser announces any offer for the sessions, such an offer will not apply to the registration fees purchased before the announcement of the offer.
After the payment is complete, You will receive a confirmation page or email that must be shown at the sessions venue to redeem Your registration fees.
If You do not receive a confirmation number after submitting payment information, or if you experience an error message or service interruption after submitting payment information, please get in touch with our customer service department to confirm whether the order has been placed or not. We don’t want You to lose money in case You assume that an order was not placed because you failed to receive confirmation.
While purchasing registration feess, You are limited to a specific number of registration fees You can buy per session.
You are consenting to receive transactional and promotional messages, or notifications, as generated by the Spotlight Platform. We will be sending notifications to you by way of the following methods:
We provide all Users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from Us on behalf of our partners, and from Us in general, after setting up an account.
If you want to remove Your contact information from all TOABH lists and newsletters, please click on the unsubscribe links in the emailer. For opting out of receiving any transactional and promotional messages or notifications on your WhatsApp account, please reach out to us at firstname.lastname@example.org and we will assist you.
In accordance with the provisions of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, any grievances which You may have with respect to the information shared by You with Spotlight Platform hereunder and its treatment, may be directed by You to the customer support of Spotlight Platform. Your complaint shall be acknowledged within 24 hours and disposed of within 15 days from the date of receipt of complaint. If your complaint pertains to any material which exposes the private area, shows full nudity, depicts sexual act or is in nature of impersonation, the complaint shall be resolved within 24 hours from receipt of complaint.
